1. Basic concepts

Request for booking rooms/services is a document sent by the Customer to the Contractor for the purpose of booking hotel and/or other services within a certain period and under certain conditions, sent by fax, e-mail using the details specified in clause 10 of this Agreement, via online booking on on the Contractor's website or by calling the booking department and administration +7 (924) 79-47-101, +7 (924) 78-47-100.

Customer - an individual who has the intention to order or purchase or who orders or purchases hotel services in accordance with a contract for the provision of hotel services in favor of the consumer.

Check-out time is the time set by the contractor for the arrival and departure of the consumer.

Booking Confirmation a written document (invoice) drawn up by the Contractor on the basis of the Customer's request, in respect of which the Contractor has given written consent to the provision of hotel and/or other services on time and on the conditions corresponding to the request, sent to the Customer by fax or e-mail using the details specified in clause 11 of this Agreement.

Hotel services – services related to accommodation, hotel accommodation and other related services provided by the Contractor to the Customer in accordance with the Rules for the Provision of Hotel Services in the Russian Federation (approved By the Decree of the Government of the Russian Federation No. 1085 dated 09.10.2015), other regulatory acts, as well as the Rules of accommodation in rooms and cottages of the recreation center "Lesnaya".

Reception – reception desk located in the administration of the recreation center «Lesnaya». It is the workplace of the administrator, and the place of registration, check-in and eviction of guests, as well as the place of reception of written statements and oral appeals of the Customer.

2. General provisions

2.1. This Offer is an official, public and irrevocable offer of a Limited Liability Company "Bonanza", represented by General Director Alexander Vasilyevich Vetchinov, acting on the basis of the Charter, hereinafter referred to as the "Contractor", to conclude a contract for the provision of hotel services with the Customer for the terms of this public offer agreement (hereinafter referred to as the "Agreement").
2.2. The public offer agreement is concluded in a special manner: by acceptance of this Agreement, i.e. by a full and unconditional response of the person about its acceptance (Article 438 of the Civil Code of the Russian Federation). In accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation, the acceptance of the essential conditions contained in this Public offer Agreement is equivalent to the conclusion of a contract for the provision of hotel services. This Agreement has legal force in accordance with Article 434 of the Civil Code of the Russian Federation and is equivalent to an agreement signed by the parties.
2.3. The fact confirming the full and unconditional acceptance (acceptance) of the terms of this public offer set out below is the payment by the Customer for services (in accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation, acceptance of the offer is equivalent to the conclusion of a contract on the terms set out in the offer). Payment of the booking request is also considered acceptance of the offer, which is equivalent to the conclusion between the Customer and the Contractor of a contract for the provision of hotel services on the terms set out in this offer.
2.4. This agreement is considered concluded from the moment of its acceptance and is valid until the parties fulfill all their obligations under this agreement.
2.5. By performing actions for the acceptance of this public offer agreement, the Customer confirms his legal capacity and legal capacity, the Customer has reached the age of 18 years, as well as the legal right of the Customer to enter into contractual relations with the Contractor.


3. Subject of the contract

3.1. The Contractor undertakes to provide hotel services, and the Customer undertakes to pay for them on the terms provided for in this Agreement.
3.2. The cost of hotel services is indicated in the Price List for services and accommodation at the recreation center "Lesnaya" located in the corner of the consumer in the administration of the recreation center "Lesnaya" near the reception and on the website .


4. Rights and obligations of the parties

4.1. The Contractor undertakes:
4.1.1. To ensure the quality of hotel services provided in accordance with the rules for the provision of hotel services in the Russian Federation and the Rules of Accommodation. 4.1.2. Provide the Customer with a Hotel room(s) in accordance with the terms of this Agreement and booking requests accepted and confirmed by the Contractor
4.1.3. To transfer to the Customer all the necessary documents related to accommodation and accommodation in a hotel, provision of other paid services.
4.1.4. Provide the Customer with information about the Hotel services and their cost, information about additional services provided for a fee, as well as the rules of Hotel accommodation by posting information on the Contractor's website, as well as at the reception at the Hotel. 4.1.5. Review the booking requests received from the Customer (for making changes to an existing reservation, for canceling an existing reservation) and within 24 hours give a written confirmation of the request (making changes, canceling the reservation) or refusal to confirm.

4.2. The Contractor has the right to:
4.2.1. To demand from the Customer upon check-in an identity document corresponding to paragraph 19 of the Decree of the Government of the Russian Federation of 09.10.2015 "On approval of the rules for the provision of hotel services in the Russian Federation". 4.2.2. Require the Customer to adhere to all procedures for ordering and booking hotel services strictly according to the rules set out on the Contractor's website and this Offer.
4.2.3. Require the Customer to fully agree with the terms of the Offer. To refuse to provide services to the Customer without agreeing to the terms of the offer.
4.2.4. Demand from the Customer full payment of the cost of hotel services, as well as additional services provided to the Customer.
4.2.5. In exceptional cases, replace previously confirmed Hotel rooms with rooms of a higher category without charging an additional fee.
4.2.6. Visits to the room where the Customer lives without the consent of the Customer in order to carry out cleaning or maintenance work in the room, in case of smoke, fire, flooding, as well as in case of violation by the Customer of this Agreement, public order, the order of use of household appliances.
4.2.7. In the absence of the Customer in the room after 6 hours from the moment of his check-out time, create a commission, make an inventory of the property in the room, remove the property from the room. The property will be at the reception during the day, after which it can be handed over to the police.
4.2.8. Involve third parties to perform services for the purposes of this agreement.

4.3. The Customer undertakes:
4.3.1. To familiarize yourself with the Rules of accommodation, the Rules for the provision of hotel services, this Agreement, and other internal documents related to the provision of the declared services.
4.3.2. Send to the Contractor a booking request, as well as amendments to the existing booking and cancellation of the existing booking of rooms in the form and in the manner provided for by this Agreement.
4.3.3. When staying at the Hotel, observe the Rules of Hotel accommodation, fire safety rules, rules for the use of electrical appliances, as well as the conditions provided for in this Agreement. Do not smoke in rooms and cottages, including hookahs and electronic cigarettes or vapes, do not use pyrotechnics throughout the recreation center.
4.3.4. To make a deposit in the amount of 5000 rubles for the period of his stay in case the Customer and his guests cause damage during their stay in the rooms. In the absence of damage by the Customer, the deposit is refunded.
4.3.5. Pay for the damage caused to the Contractor's property according to the current price list.
4.3.6. Do not transfer the room key to third parties, do not leave unauthorized persons in the room in your absence.
4.3.7. Before leaving the room, make sure that the windows and doors are closed, the electrical appliances from the sockets and the electric light are turned off.
4.3.8. Hand over the hotel room in a timely manner, if necessary, pay for damage caused by incompleteness (loss of property) or damage to property, make payment in accordance with the current Price List for property damage.
4.3.9. Pay for the Contractor's services under the terms of this Agreement.
4.3.10. Independently get acquainted on the Contractor's website, as well as in the Hotel with information about the types of services, prices for them and conditions for their provision.
4.3.11. Promptly provide all the necessary reliable information (the Customer's full name, passport data, accurate information about the postal address, phone, e-mail required by the Contractor for operational communication with the Customer) and original documents for the provision of services by the Contractor.
4.3.12. Before paying for services, independently obtain all the necessary information to determine the quality and scope of the Contractor's services by reviewing the information on the Contractor's website. The Customer agrees that his payment for the Contractor's services means that the Customer has received full information about the paid services.
4.3.13. At the end of the period of stay, vacate the room before check-out time (12.00 of the current day), the extension of the period of stay is made subject to availability.
4.3.14. Foreign citizens must have a request for entry and stay of foreign citizens in the territory with a regulated visit to the Kamchatka Territory in the Federal Security Service of Russia in the Kamchatka Territory upon check-in. The application is made on the travel organizer's letterhead, must contain the following data of a foreign citizen in Latin and in Russian: surname, first name, date of birth, nationality, identity document data; the purpose of entry, the period of stay, the data of the vehicles on which foreign citizens will travel, information about the persons accompanying foreign citizens on the trip, the route of movement.

4.4. The Customer has the right to:
4.4.1. Request from the Contractor accurate and complete information about the category and location of the hotel, as well as about the services provided.4.4.2. Make changes and cancel confirmed bookings in accordance with clause 5 of this Agreement.

5. The order of booking and payment of the room

5.1. Booking a hotel room is carried out by the Customer independently using Internet resources. The request for booking a room can also be sent by the Customer to the administrator or manager of the Hotel by phone, directly from the reception desk or by e-mail. 5.2. The Customer must specify the following information in the application:
- Full name of the Customer (accompanying persons, legal representatives);
- gender, nationality, date of birth of the Customer (accompanying persons, legal representatives),
- terms of stay, date and time of arrival and departure;
- categories and number of rooms to be booked, the need for equipment in the room for additional beds.
5.3. The payment for accommodation and services at the Hotel is established by the Price List approved by the Contractor and posted on the website . Payment is made in rubles in cash, by wire transfer to the account, using settlement or bank cards, online booking systems or otherwise. The Customer's check-in at the Hotel is made only after advance payment for accommodation. A receipt or receipt and an invoice for services rendered are issued to the Customer directly at the hotel after payment for the relevant services.
5.4. The Contractor sends the invoice to the Customer, in agreement with the latter, by e-mail or to the WhatsApp or Telegram messenger.
5.5. Settlements between the Contractor and the Customer are made in rubles. Payment by bank transfer is made by the Customer to the Contractor's settlement account within 1 (one) banking day from the moment the Contractor issues an invoice for services.
5.6. The Customer pays the full cost of the reservation at the time of booking.
5.7. To confirm the payment of the reservation, the Customer sends the executed payment order in the same way as he received the invoice.5.8. The fact of a non-cash payment is the receipt of the Customer's money to the Contractor's settlement account.
5.9. Depending on the date and duration of stay, the room rate may vary. The price may also include catering, leisure and other services. The actual cost of accommodation services for the relevant dates, indicating the list of services provided included in the cost of accommodation, are indicated on the Contractor's website.5.10. The accommodation fee is charged from the beginning of the check-out time at the Hotel, regardless of the actual time of the Customer's check-in to the room. If the Customer stays in the room for no more than a day (up to 24 hours), the fee is charged for a full day.
5.11. In case of delayed departure of the Customer by agreement with the Contractor later than the pre-paid period, the fee for extending the stay is charged at the rate of 5% of the daily cost of accommodation for each hour of delay. The maximum extension of the stay is 3 hours. In case of a longer delay in departure, the Customer pays the daily cost of accommodation.

6. Change and cancellation of the reservation.

6.1. The Customer has the right to make changes (clarifications) to the application no later than 3 calendar days before the day of arrival concerning the Full name, gender, citizenship, date of birth of accompanying persons and legal representatives.
6.2. The Customer has the right to change the dates of stay once no later than 7 days before the time of arrival. To do this, the Customer sends an application in a free form indicating the full name, booking date and desired dates of stay by e-mail . Change of dates of stay is made subject to availability.
6.3. The Customer has the right to cancel the reservation without penalty no later than 14 days before the time of arrival. To do this, the Customer sends an application in a free form with an indication of full name, booking date to e-mail .
6.4. If the booking is cancelled later than 14 days before the time of arrival, the Customer will be charged a fine in the amount of the cost of the first night's stay, and if the booking is cancelled later than 3 days before the time of arrival or in case of no-show, in the amount of the cost of the entire reservation.

7. Responsibility of the parties

7.1. For violation of the terms of the Contract, the Parties are liable under the legislation of the Russian Federation.
7.2. The Contractor shall not be liable in the event of non-performance or improper performance of the services on its part or on the part of third parties, arising from the unreliability, insufficiency or untimeness of the supporting information and documents provided by the Customer, as well as arising from other violations of the terms of this Contract of the offer on the part of the Customer.
7.3. The Contractor is not responsible for the quality of the utilities provided to the Customer, but is obliged to provide objective information about the planned work of city services and resource-supplying organizations, which may affect the quality of the utilities provided.
7.4. The Customer represents the interests of all persons specified in the order, and is personally responsible to the Contractor for the correctness of the data provided in the application about them, for the fulfillment by all persons of all obligations, including obligations to pay for the order.
7.5. The Contractor is not responsible for the safety of money left or forgotten in the room, other currency valuables, securities and valuables of the Customer, with the exception of things left in the safe at the reception. If forgotten items are found, the hotel administration immediately notifies the owner of the items. If the person who has the right to claim the forgotten thing, or the place of his stay is unknown, the Performer declares the discovery to the police.
7.6. Disputes on the execution of this agreement are subject to consideration by the appropriate court at the location of the Contractor with mandatory compliance with the claim procedure. The deadline for responding to the claim is 10 calendar days from the date of receipt.
7.7. In all other matters not provided for in this Offer Agreement, the Parties are guided by the current legislation of the Russian Federation.

8. Force majeure circumstances

8.1. The Parties are released from liability for partial or complete non-fulfillment of their obligations under this Offer Agreement if their fulfillment is prevented by an extraordinary and unavoidable circumstance under these conditions (force majeure).
8.2. In the event of force majeure circumstances preventing one of the Parties from fulfilling its obligations under this Agreement, it is obliged to notify the other Party no later than 3 (three) days from the moment of occurrence of such circumstances, while the deadline for fulfilling obligations under this Agreement is postponed in proportion to the time during which such circumstances were in effect.


9. Personal data protection

9.1. In accordance with Part 2 of Article 6 of Federal Law No. 152-FZ of July 27, 2006 On Personal Data, the processing of the Customer's personal data is carried out for the purpose of fulfilling this Agreement, one of the parties to which is the Customer. The Customer's personal information is not subject to dissemination, except in cases provided for by the legislation of the Russian Federation.
9.2. The Contractor undertakes to use all the personal data of the Customer specified by him during registration and during the ordering process exclusively for the sale of the relevant services, identification and support of the Customer. The Contractor undertakes under no circumstances to use the Customer's personal data for unauthorized distribution of materials not related to the services provided by the Contractor.
9.3. Upon conclusion of this Agreement, the Customer agrees to the processing of his personal data by the Contractor in order to provide hotel services at the Hotel.

10. Procedure for amendment and termination of the contract

10.1. This Agreement comes into force from the moment of its conclusion (acceptance of the offer) and is valid until the parties fully fulfill their obligations.
10.2. The Customer has the right to refuse the Contractor's services at any time. The refusal of the Customer entails the termination of all obligations of the Contractor to him from the moment of such refusal. The Contractor withholds from the Customer the amount of the fine for cancellation of the reservation in accordance with clause 6.4.
10.3. The Contractor has the right to unilaterally terminate this Agreement.
10.4. The Contractor has the right to change the terms of this Agreement and its Annexes, to introduce new Annexes to this Agreement without prior notice. The customer, aware of the possibility of such changes, agrees that they will be made. If the Customer continues to use the Contractor's services after such changes, this means that he agrees with them.
